MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF CERRITOS
HELD MAY 9, 2005

CALL TO ORDER

Mayor John Crawley called the meeting to order at 7:00 p.m. in the Council Chambers at Cerritos City Hall, 18125 Bloomfield Avenue, Cerritos, California.

INVOCATION

Councilwoman Gloria Kappe offered the invocation.

PLEDGE OF ALLEGIANCE

Mayor Pro Tem Bowlen led the assembly in the salute to the flag.

PRESENTATIONS

Jack Sholl and James C. McHargue of the Pennsylvania Society of the Sons of the Revolution presented a Betsy Ross Flag to the City Council, which has been flown over Independence Hall, Paoli Battlefield, Tomb of the Unknown Soldier of the American Revolution in Washington Square, Betsy Ross House, Valley Forge, Germantown, Washington’s Crossing and Brandywine, for incorporation into the City’s Let Freedom Ring Celebration formal ceremony.


PUBLIC COMMENTS AND SUGGESTIONS

Alon Barlevy, Cerritos resident and President of the Hubert Humphrey Democratic Club, requested that the Council consider a celebration honoring Martin Luther King, Jr. for 2006 in the City’s budget.

Sylvia Rodriguez, Cerritos resident and ABC Unified School District educator, spoke in support of recognizing the Martin Luther King, Jr. holiday; read a report written by a student regarding Martin Luther King, Jr.; and requested that the Council consider declaring Martin Luther King, Jr. as an official holiday for 2006.

Sally Havice, Cerritos resident, expressed appreciation for the City’s involvement in the National Parks Service special resource study; and spoke in support of and requested that the Council consider the community’s request in recognizing the Martin Luther King, Jr. holiday.
 

Anise Jones, Cerritos resident and member of Delta Sigma Beta Sorority, provided background information relative to the sorority and offered its assistance in a celebration honoring Martin Luther King, Jr.

Jim Johnson, Cerritos resident, requested that the Council recognize the Martin Luther King, Jr. holiday.

Dashul Masaoka, former Cerritos resident, spoke in support of and requested that the Council recognize the Martin Luther King, Jr. holiday.

Julietta Williams, Cerritos resident, requested that the Council consider recognizing the Martin Luther King, Jr. holiday.

Brittney Nulty, Whitney High School student, discussed the importance of recognizing the Martin Luther King, Jr. holiday and having a celebration in his honor.

Cecil Goff, Cerritos resident, discussed the importance of world peace and suggested a cultural diversity celebration.

Edward Butler, Cerritos resident, suggested a Martin Luther King, Jr. “Diverse Cultural Day” honoring Martin Luther King, Jr. and celebrating the cultural diversity in Cerritos; and suggested that the City’s Rose Parade Float display the cultural diversity in Cerritos.

Billie Vincent, Cerritos resident, suggested that Cerritos take the lead in honoring the Martin Luther King, Jr. holiday.

CONSENSUS: It was the consensus of the City Council to place the matter of the Martin Luther King, Jr. holiday and celebration on the June 2, 2005 Study Session Agenda.


CONSENT CALENDAR ITEMS

Approval of Register of Demands

MOTION:  Mayor Pro Tem Bowlen moved to approve the Register of Demands dated May 9, 2005, Checks 70811 through 70974 and Checks 70975 through 71182, in the total amount of $3,804,158.99. The motion was seconded by Councilwoman Lee and unanimously carried.

Approval of Minutes

MOTION:  It was moved by Mayor Pro Tem Bowlen to approve the Minutes of the April 28, 2005 City Council Regular Meeting. The motion was seconded by Councilwoman Lee and unanimously carried.

PUBLIC HEARINGS

 A proposal by Matson Architects, 13271 South Street, Cerritos, California 90703, on behalf of the business owner, Townsend Automotive Group, 5425 East La Palma, Anaheim Hills, California 92807 to amend the General Plan Map and Development Map (zoning/land use) designation of a parcel measuring approximately ±2.00 acres, located at 10861 183rd Street, Cerritos, California 90703. The proposed amendments will change the land use designation of the subject parcel from Educational Use to Development Area Five (ADP-5) and will change the zone classification from Single Family Residential (RS-6500) to Development Area Five (ADP-5). The subject site is located in the Los Cerritos Redevelopment Project Area (APN 7034-017-033).

One Mitigated Negative Declaration was prepared for the proposed Cerritos Jaguar/Land Rover Automobile Dealership and the proposed Valley Christian School Parking Lot, inclusive of all related entitlements and amendments, for this project and was considered at a public hearing before the Cerritos City Council/Redevelopment Agency on April 28, 2005.

Consideration to waive reading of and adopt A RESOLUTION OF THE CERRITOS CITY COUNCIL AMENDING THE CERRITOS GENERAL PLAN BY CHANGING THE LAND USE DESIGNATION OF APPROXIMATELY ±2.00 ACRES OF LAND, LOCATED NORTHEAST OF 183RD STREET AND DUMONT AVENUE AT 10861 183RD STREET, CERRITOS, CALIFORNIA 90703, AND WITHIN THE LOS CERRITOS REDEVELOPMENT PROJECT AREA, FROM EDUCATIONAL USE TO DEVELOPMENT AREA FIVE (ADP-5).

Consideration to waive reading of and introduce AN ORDINANCE OF THE CITY OF CERRITOS AMENDING THE CERRITOS DEVELOPMENT MAP BY CHANGING THE ZONE CLASSIFICATION OF APPROXIMATELY ±2.00 ACRES OF LAND, LOCATED NORTHEAST OF 183RD STREET AND DUMONT AVENUE AT 10861 183RD STREET, CERRITOS, CALIFORNIA 90703, AND WITHIN THE LOS CERRITOS REDEVELOPMENT PROJECT AREA, FROM SINGLE FAMILY RESIDENTIAL (RS-6500) TO DEVELOPMENT AREA FIVE (ADP-5).

A proposal by Matson Architects, 13271 South Street, Cerritos, California 90703, on behalf of the business owner, Townsend Automotive Group, 5425 East La Palma, Anaheim Hills, California 92807 to develop a new Cerritos Jaguar/Land Rover dealership. Included in the proposal is the construction of a ±89,222 square foot building, which incorporates a one-story showroom with a four-level structure, for office uses, auto service and auto storage. The subject site is located at 10861 183rd Street, is currently zoned RS-6500, Single Family Residential, and is located in the Los Cerritos Redevelopment Project Area (APN 7034-017-033).

One Mitigated Negative Declaration was prepared for the proposed Cerritos Jaguar/Land Rover Automobile Dealership and the proposed Valley Christian School Parking Lot, inclusive of all related entitlements and amendments, for this project and was considered at a public hearing before the Cerritos City Council/Redevelopment Agency on April 28, 2005.

It was noted that the foregoing items would be heard concurrently. The Mayor read title to the items, declared the public hearings open and called upon staff for reports.

Community Development Director Contreras presented background information and an overview of the exchange of Agency-owned property for property owned by Valley Christian Schools. He reviewed the proposed traffic circulation relative to automobile delivery, photographs of existing landscape screening material, and site plan and aerial photograph of the site and surrounding land uses.

Associate Planner Lopez provided an overview of the staff reports dated May 9, 2005, relative to General Plan Amendment 2005-2, Development Map Amendment 2005-2 and Development Code Amendment 2005-3. He indicated that the proposed amendments would facilitate the development of the proposed Jaguar/Land Rover dealership at the Cerritos Auto Square. He reviewed public noticing for the hearing, Mitigated Negative Declaration, location map, and ADP-5 expansion area.

Senior Planner Cisneros reviewed the staff report dated May 9, 2005 relative to Cerritos Redevelopment Agency Conformity Report 2005-7, Conditional Use Permit 2005-2 and Precise Plan 2005-12.  She identified the location of the site, and reviewed the site plan, perspective renderings, landscaping, test track and architectural design elements.  The following modified Condition of Approval No. *51 was presented by Ms. Cisneros:

Absolutely no vehicles associated with the subject dealership shall be test driven within the residential areas and/or along Dumont Avenue adjacent to Valley Christian Schools. Employees of the Cerritos Jaguar/Land Rover dealership shall sign an acknowledgement to this restriction. Such acknowledgement is to be kept on file in the dealership for the future enforcement of this provision and for the extent of the employment of said employees. This restriction shall also be included in the CC&Rs.

In response to Council inquiry, Ms. Cisneros addressed building setbacks and landscape screening on the north property line; and Mr. Contreras discussed the purpose of the proposed vehicle test track and Condition of Approval No. *53 relative to automobile delivery schedule restrictions.

Josh Townsend, Townsend Automotive Group, elaborated on the purpose of the proposed test track, noting the simulation capabilities and architectural elements.

Interested parties were invited to present testimony. 

Edward Butler, Cerritos resident, discussed previous concerns associated with signage, noise and test driving vehicles in residential areas; requested that the automobile dealership work with the neighborhood in addressing concerns; and requested the Council support in addressing future concerns associated with the dealership activities.

Josh Townsend, Townsend Automotive Group, referenced comments made by Mr. Butler, stating that the dealership will comply with Condition of Approval No. *51, as amended; addressed vehicle delivery, stating that deliveries would be prohibited at the dealership between 7:00 am and 9:00 am and 4:00 pm and 6:00 pm; and observed inflatable signage at the dealership is also prohibited.

Roger Udabe, Cerritos resident, inquired as to an oil containment system in the event of spillage; suggested constructing a subterranean parking structure and reducing the building elevation for consistency with adjacent buildings; inquired about vehicle screening on the rooftop and inflatable and other signage for the dealership; expressed concern with traffic impacts associated with automobile delivery during peak traffic periods in the morning and afternoon; and commented on state filing requirements related to the vacant Dumont Avenue parcel.

Mr. Contreras responded that the proposed 47 foot building height is consistent with adjacent buildings, noting the building directly across from the subject site is 45 feet in height; discussed Condition of Approval No. *48 relative to the roof cross-section and line-of-sight study requirement for mechanical equipment screening; discussed the temporary use permit requirements for inflatable signage; and addressed traffic  concerns associated with vehicle delivery, noting the school and dealership were involved in developing the delivery schedule in the conditions of approval.

Assistant City Manager/Public Works Brar addressed the National Pollutant Discharge Elimination System municipal stormwater permit requirements for the proposed parking lot on the vacant Dumont Avenue parcel.

John Matson, Matson Architects, stated that automotive fluid storage areas are regulated and inspected by the Fire Department, the building is setback to reduce its mass, and the building height is comparable with the adjacent buildings.  He also addressed vehicle and equipment screening on the roof of the building, and proposed dealership signage 

No one else wished to address the City Council on this matter and the public hearing was closed.

In response to Council inquiry, City Manager Gallucci discussed the proposed building elevation, setbacks and Condition of Approval No. *52 relative to vehicle alarm restrictions.

A resolution of the Cerritos City Council amending the Cerritos General Plan by changing the land use designation of approximately ±2.00 acres of land, located northeast of 183rd Street and Dumont Avenue at 10861 183rd Street, Cerritos, California 90703, and within the Los Cerritos Redevelopment Project Area, from Educational Use to Development Area Five 
(ADP-5). 

MOTION:  It was moved by Councilwoman Lee and seconded by Councilwoman Kappe to waive reading of and adopt Resolution No. 2005-9.  The motion unanimously carried.

B.         Approve Conditional Use Permit 2005-2, making the findings set forth in Planning Commission Resolution No. PC 2005-33;

C.        Approve Precise Plan 2005-12, making the findings set forth in Planning Commission Resolution No. 2005-34;

as recommended in the staff report dated May 9, 2005, with the modified Condition of Approval No. *51 as presented this evening.  The motion unanimously carried.

A proposal by Valley Christian Schools, 10818 Artesia Boulevard, Cerritos, California 90703, to amend the General Plan Map and Development Map (zoning/land use) designation of a parcel measuring approximately ±4.23 acres, located at 17601 Dumont Avenue, Cerritos, California 90703, and the Development Map (zoning) designation of a parcel measuring approximately ±28.10 acres, located at 10818 Artesia Boulevard, Cerritos, California 90703. The proposed amendments will change the first subject parcel's land use designation from Light Industrial to Educational Use and zone classification from Agricultural (A) to Open Space (OS) and will change the second subject parcel's zone classification from Single Family Residential (RS-6500) to Open Space (OS). The subject sites are located in the Los Cerritos Redevelopment Project Area (APN 7034-018-900 and APN 7034-017-033).

Title to the foregoing item was read, the public hearing opened, and staff called upon for a report.

Associate Planner Lopez presented an overview of the staff report dated May 9, 2005.  He stated that the proposed amendments to the General Plan and Development Map are associated with the property exchange between Valley Christian Schools and the Cerritos Redevelopment Agency and will assist the School in developing its Master Plan.  He reviewed public noticing for the hearing, Mitigated Negative Declaration, location map, and proposed changes to the Development Map and General Plan Land Use Map.  He reported that the Planning Commission recommended approval of the proposed amendments.

Interested parties were invited to present testimony. 

Kevin Kaemingk, Downey resident and Valley Christian Schools Superintendent, spoke in support of the proposed amendments.

No one else wished to address the City Council on this matter and the public hearing was closed.

RESOLUTION NO. 2005-10

A resolution of the Cerritos City Council amending the Cerritos General Plan by changing the land use designation of approximately ±4.23 acres of land located at 17601 Dumont Avenue, Cerritos, California 90703, and within the Los Cerritos Redevelopment Project Area, from Light Industrial to Educational Use. 

MOTION:  It was moved by Councilwoman Lee and seconded by Councilwoman Kappe to waive reading of and adopt Resolution No. 2005-10.  The motion unanimously carried.

ORDINANCE NO. 900

An ordinance of the City of Cerritos amending the Cerritos Development Map by changing the zone classification of approximately ±4.23 acres of land located at 17601 Dumont Avenue, Cerritos, California 90703, and within the Los Cerritos Redevelopment Project Area, from Agricultural (A) to Open Space (OS). 

MOTION: Councilwoman Lee moved to waive reading of and introduce Ordinance No. 900. The motion was seconded by Councilwoman Kappe and carried by the following vote:

RESOLUTION NO. 2005-11

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CERRITOS AUTHORIZING STAFF TO NEGOGIATE A CONTRACT FOR THE CONSTRUCTION OF THE CERRITOS SCULPTURE GARDEN, PROJECT NO. 10077, IN ACCORDANCE WITH PUBLIC CONTRACT CODE 20167.

MOTION:  It was moved by Councilman Edwards and seconded by Councilwoman Lee to waive reading of and adopt Resolution No. 2005-11.  The motion unanimously carried.

PUBLIC WORKS ACTIVITIES

Consideration of an award of contract for application of emulsion-aggregate Type II slurry at Studebaker Road from 195th Street to northerly City limit and Type I slurry at various locations in residential streets, Bid No. 998-05, Projects No. 14077-05-I and 14088-05-I.

MOTION:  It was moved by Councilwoman Lee and seconded by Councilwoman Kappe to award a contract for the application of emulsion-aggregate Type II slurry at Studebaker Road from 195th Street to northerly City limit and Type I slurry at various locations in residential streets, Bid No.  998-05, Projects No. 14077-05-I and 14088-05-I, to Roy Allan Slurry Seal, Inc. in the amount of $188,989.40, and reject all other bids; and authorize staff to negotiate with Roy Allan Slurry Seal, Inc. to include additional areas of slurry seal application in an amount not to exceed $61,000.   The motion unanimously carried.

NEW AND OLD BUSINESS

Review and consideration of artwork to be installed in the sculpture garden that will be located in the Cerritos Civic Center complex on the northwest corner of 183rd Street and Bloomfield Avenue, west of the Sheriff Station (APN 7025-028-904).

MOTION:  It was moved by Councilwoman Kappe and seconded by Councilwoman Lee to concur with the recommendation of the Fine Arts and Historical Commission and approve the “Statue of Freedom” for installation in the Cerritos Sculpture Garden located in the Cerritos Civic Center complex on the northwest corner of 183rd Street and Bloomfield Avenue, west of the Sheriff Station, at the location specified on Attachment C of the staff report dated May 9, 2005; and approve the amount of $40,000, plus approximately $7500 for shipping, insurance and installation of the “Statue of Freedom”; and direct that the cost of the pedestal will be determined upon the recommendation of the Fine Arts and Historical Commission and will be a separate action of the City Council/Redevelopment Agency at a future date.  The motion unanimously carried.

CITY COUNCIL COMMUNICATIONS/COMMITTEE REPORTS

Councilwoman Kappe suggested that an educational component be included in the Martin Luther King, Jr. celebration matter scheduled for the June 2, 2005 Study Session.

Mayor Pro Tem Bowlen reported on his attendance at the Mother’s Day Tea at the Cerritos Senior Center and encouraged the community’s involvement in the upcoming American Cancer Society’s Relay for Life at Gahr High School.

Councilwoman Lee commented on the success of the Cerritos Library Teen Contests in Art, Poetry, Photography and Short Story and reported on her participation at the Mayors for Peace Conference at the United Nations.

Councilman Edwards also commented on the success of the Cerritos Library Teen Contests.

Mayor Crawley reported on his attendance at the Gateway Cities Council of Governments Meeting, Southeast Water Coalition Meeting and Philippine Society of Southeast Los Angeles Anniversary Ball.
 

ADJOURNMENT

There being no further business to come before the City Council, the meeting adjourned at 8:55 p.m.
